Art. 1 Conclusion of the contract
1.1 Orders shall be construed subject to acceptance of Alari prints. The correct order is confirmed by Alari prints using an email response sent to the email address supplied by the customer. This confirmation message contains the order number, order date, billing information, and recipient of the goods, details and VAT included prices of merchandise, transport service and additional services, payment, data mode prints Alari, notes and warnings to the customer. Art. 2 Acceptance of the General Conditions of Sale
2.1. 2.2 The General Conditions of Sale concerning the customer qualifies "Consumer", will only apply to the natural person who, in accordance with art. 3 of Legislative Decree no. n. 206 8/10/2005 SS MM, "acting for purposes not related to business, commercial, craft or profession". In particular art. 5 (two-year warranty) and 6 (withdrawal) will apply only and exclusively if the Customer qualifies as a consumer.
2.3 The Customer declares that he has examined the General Conditions of Sale before forwarding its purchase order and undertakes, once the online purchase procedure, to print or save an electronic copy, however, retain the these Conditions, already examined and accepted, under and for the purposes of Articles. 3:04 d. lgs. 185/99 and of the d. lgs. 206/2005.
Art. 3 Payment
3.1 The customer can make the payment had to choose from the following methods: advance payment by bank transfer to prints Alari at Monte dei Paschi di Siena IBAN IT xxx, performed within 48 hours of order and anticipated confirmation by e-mail to firstname.lastname@example.org, including taxes and shipping charges.
Art. 4 Delivery
4.1 Delivery expenditure in Italy amounted to € 12.00. For Europe and the rest of the world the customer will be contacted by mail after making the order and will be presented in addition to the cost of the products chosen also its shipping cost which will be done through the primary carrier. 4.2 Delivery is made to the number of the recipient or such other place indicated in the transport document (d.d.t.), but at street level. 4.3 The goods will be delivered between 3 and 30 working days. Prints Alari is not responsible for any delivery delays or additional expenses charged to the customer for the case in which is provided an incomplete or incorrect address. The goods travel with regular transport document is deemed delivered at the place specified by the customer when the order confirmation, unless otherwise stated.
4.5 For deliveries abroad, conditions and procedures must be defined with prints Alari.
4.6 The ordered goods are covered by insurance for the entire duration of the expedition. Art. 5 Warranty
5.1 The products purchased by the customer not consumer (ie in case of purchase as part of their business or profession) are covered by standard warranty is 12 months for defects of conformity, not evident at the time of purchase.
5.2 The products purchased by the customer consumer (ie in case of purchase for purposes not related to his business or professional activity) are covered by a legal guarantee of two years for lack of conformity, not evident at the time of purchase.
5.3 In case of conformity defect prints Alari will, without cost to the customer, replacement of the product. The customer must check the goods within 5 days of delivery. Defects already present at delivery of the material will have to be communicated to Alari prints within 5 days of its receipt by e-mail to firstname.lastname@example.org, indicating the item code, details and photographs of the defect.
5.4 In the event that prints Alari was not able to make the customer a product warranty (restored or replaced), the same shall arrange for consensual replacement with a product of comparable or exceed that challenged or refund the amount paid taking into account the use of the asset. In case of replacement under warranty, the customer must send at its expense the defective product at the headquarters of the Seller sending it to prints Alari, Via S. Carpoforo n. 4 20121 Milano. Good warranty must be returned by Customer in its original packaging sealed properly, complete in all its parts. The customer is required to keep the original box and all additional documentation of products purchased until the lapse of the terms of the product warranty.
5.5 No damage will be asked Prints Alari for any delays in repairs or replacements. If the defect reported does not result in a lack of conformity pursuant to Art. 129 d. Decree 206/2005, the customer will be charged the cost of verification, recovery and transport, if supported by Alari prints.
5.6 Prints Alari does not assume responsibility in case of improper use of products (eg storage of prints in damp or unhealthy environments for delicate products such as prints). Warranty does not cover direct or indirect damage caused by errors or discrepancies in the installation of the product, negligence or the user's inability, or due to unforeseeable circumstances or force majeure or unauthorized third party intervention. The warranty does not cover wear parts.
Art. 6 Right of withdrawal Consumer Customer
6.1 The Customer consumer has the right to cancel the contract without penalty and without giving any reason within 14 (fourteen) days of receipt of goods by registered mail a / r to be transmitted to the headquarters of the company prints Alari to the following address: prints Alari Via S. 6.2 Prints Alari will refund the price within the maximum term of 14 (fourteen) days from the day of receipt of the Consumer communication. In any case, Eurodet Sas will be entitled to withhold the reimbursement until the date of receipt of the goods or demonstration by the Consumer to have them returned.
6.3, the direct cost of returning the goods are borne by the consumer. Shipping for returning the material, up to the certification of receipt in our warehouse is under the complete responsibility of the customer. Prints Alari does not respond in any way for damage or theft / loss of goods returned with shipments not insured by the customer.
6.4 The right of withdrawal is excluded in the following cases: a) the original packaging; b) the absence of product components (eg. passpartou or accessories and generally different conditions in which they were delivered); c) damage to the product (eg. products not substantially intact, used or any other, differences, deterioration, wear and tear and / or alterations of any kind) d) purchase of customized products according to the information required by the customer.
6.5 The customer is not the consumer has NO right of withdrawal.
Art. 7 Governing Law and Jurisdiction
7.1 This contract is governed by Italian law.
7.2 Except in the case of a contract concluded with a consumer, for all disputes arising from the application or interpretation of this contract will be the competent court of Milan.
